¿Cómo elijo a un preparador de impuestos? How do I choose a tax preparer?

Look for someone with a PTIN who signs your return and gives you a copy, asks to see your records and does not promise you a bigger refund. Every paid preparer must have a PTIN, but not all of them can represent you before the IRS: that depends on their credentials.

01Lo básicoThe basics

Cinco cosas que el IRS pide revisar.Five things the IRS says to check.

01Que tenga PTINA PTIN

Everyone paid to prepare federal returns must have an IRS-issued preparer tax identification number (PTIN) and enter it on the return that is filed. It does not have to appear on your copy.

02Que firme y te dé una copiaA signature and a copy

The paid preparer signs the return and gives you a copy.

03Que pida ver tus registrosThey ask for your records

Un buen preparador pide ver tus registros y recibos.A good preparer asks to see your records and receipts.

04Que siga ahí despuésThey will still be around

Consider whether you can reach them years after filing. Check their history, for example with the local Better Business Bureau, and verify their credentials.

The IRS recommends always asking about their education and training: preparers have differing levels of skills, education and expertise.

02CredencialesCredentials

Preparar y representar no son lo mismo.Preparing and representing are not the same.

Any tax professional with a PTIN can prepare federal returns. Representing you before the IRS — in an audit, a collection matter or an appeal — depends on the credential.

Who can do what before the IRS, from narrower to wider reach.
Agentes inscritos, CPA y abogadosEnrolled agents, CPAs and attorneys

They have unlimited representation rights: they can represent you before the IRS on any matter, including audits, payment and collection issues, and appeals.

Enrolled agents (EAs) are licensed by the IRS after a three-part exam; CPAs by state boards of accountancy; attorneys by state courts or their designees, such as a state bar.

The Annual Filing Season Program (AFSP) is voluntary, for preparers who are generally not attorneys, CPAs or EAs. After the required continuing-education hours they receive a record of completion for a given tax year.

They have limited representation rights: only for returns they prepared and signed, and only before certain IRS staff. They cannot handle appeals or collection matters.

Since January 1, 2016 they may prepare returns only. They cannot represent clients before the IRS, except for returns they prepared and filed on or before December 31, 2015.

If you see one of these, look elsewhere.

01Cobra un porcentaje de tu reembolsoThey charge a percentage of your refund

The IRS says to avoid preparers who base their fee on a percentage of the refund.

02Quiere tu reembolso en su cuentaThey want your refund in their account

Avoid anyone who offers to deposit all or part of your refund into their own financial accounts.

Be wary of anyone who promises larger refunds than other preparers can get.

04Te pide firmar en blancoThey ask you to sign a blank form

Never sign a blank or incomplete return.

05No firma ni pone su PTINThey will not sign or add a PTIN

The IRS calls a preparer who prepares a return but refuses to sign it or add a PTIN a “ghost preparer”. It calls this a major red flag, because you are legally responsible for what is filed.

04Cómo verificarHow to check

Lo que puedes revisar por tu cuenta. What you can check yourself.

The IRS has a public directory listing the name, city, state and ZIP code of attorneys, CPAs, enrolled agents and other credentialed professionals, plus AFSP record of completion holders. You can reach it from its credentials page.

Not appearing in the directory does not mean someone prepares returns poorly: the IRS says they may provide quality service, but to choose any preparer wisely.

If a preparer’s misconduct harmed you financially, the IRS has a page for filing a complaint.
